POSITION: Legal Advisor
LOCATION: Johannesburg office based, but frequent travel
throughout SA

Consideration will be given to the Demographics as depicted in the
Economically Active Population released by the Labour
Department.

REQUIREMENTS:
• LLB Degree or equivalent
• Admitted Attorney or Advocate
• Minimum of 5 years practical experience in litigation
• Proven experience in execution of awards/rulings/ court orders
• Experience in demarcations
• Proven experience in preparing for litigation
• Knowledge of dispute resolution processes
• Proven experience in preparing instructions for attorneys, sheriffs
and other related legal processes
• Understanding of Bargaining Councils and Industry Collective
Agreements
• Solid understanding of business rescue and liquidation principles
and processes and how to protect or pursue stakeholder’s rights
• Sound experience of dealing with trade unions and employer’s
organisations
• Demonstrate sound knowledge of SA Law, including labour and civil
procedural law applicable to all types of SA Courts and Tribunal
• Proven ability to prepare and represent a case in court or at CCMA
and experience in relevant processed and procedures
• Excellent verbal and written communication skills in multiple South
African official languages including English, Xhosa, Sesotho will be
advantageous
• Ability to deal with conflict and difficult stake holders
• Self-disciplined and able to adhere to strict timeframes
• Ability to prioritise workload in line with strict timeframes to
optimise the use of resources
• Proven ability to find creative and innovative solutions to problems
and to overcome potential challenges (think on your feet)
• Possession of valid driver’s license and own car – Will be required to
travel extensively nationally

 

RESPONSIBILITIES will include, but are not limited:
• To oversee, manage and monitor the enforcement process from
arbitration onwards
• To oversee the administrative process of enforcement arbitration
and to assist with arbitrations when required in consultation with
relevant parties
• To draft and review legal documentation, with emphasis on
arbitrations and demarcations as well as Court litigation
• To build, manage and maintain good internal and external
relationships
• To manage all litigation matters from inception to conclusion
• To liaise and communicate with external legal service providers and
to collaborate with other legal professionals
• Responsible to oversee, manage and attend to compliance review
applications in Labour Court
• To assist in Labour Court and Labour Appeal Court litigation, as well
as High Court and Magistrate’s Court litigation
• To analyse the validity of claims and making recommendations to the
Operations Manager, including the interpretation of relevant
legislation and provision of legal opinions to management
• To compile and draft heads of arguments and applications
• To design proactive and innovative litigation processes and
initiatives for BCCEI in conjunction with Operations Manager to
increase efficiencies
• To work closely with the Senior Agents and Compliance
Administration Supervisor during the execution enforcement of
arbitration award process
• To provide continuous feedback to all internal parties to ensure
alignment
